PDP Petition: Edo Tribunal to serve Obaseki, APC through substituted means


Edo State Governorship Election Petitions Tribunal sitting in Benin City yesterday ordered that the All Progressives Congress, APC and the Governor- Elect, Mr. Godwin Obaseki be serve the petition filed by the PDP governorship candidate, Osagie Ize- Iyamu through substituted means .

In suit No. EPT/EDS/ GOV/3/2016, the Peoples Democratic Party, PDP and Pastor Osagie Ize-Iyamu are challenging the outcome of the September 28 governorship election won by the APC candidate, Mr. Godwin Obaseki Chairman of the Tribunal, Justice Badamasi gave the order after the motion exparte were argued by counsels to the petitioners.

“ The application is hereby granted as prayed”, because, “it falls in line with paragraph 47 first schedule of the Electoral Act as amended and Sections 5(6) 5 of the High Court rules”, applicable to the tribunal. Counsels to the petitioners had prayed the court for an order to enable them to serve the APC and Mr. Godwin Obaseki their petition by substituted means , “to wit by pasting the said petition and all other processes on the wall or door of the last known addresses”, of the APC and Mr Obaseki.

They equally posited that the last known addresses ofthe defendants are: the APC state headquarters along Airport Road, Benin City, Edo state for the APC and No. 8 Commercial Road, GRA, Benin City, Edo state for Mr. Obaseki.

They argued that the grounds for their application were that the bailiff of the Honourable tribunal has made several attempts to personally serve the APC and Mr. Obaseki, “but all to no avail”, hence the “leave of the Honourable tribunal is required “, for the APC and Mr. Obaseki to be served by substituted means.

Supreme Court doesn’t need 21 justices – CJN

The acting Chief Justice of Nigeria, Justice Walter Onnoghen, has said appointing more judges or increasing the number of courtrooms are not the solutions to the problem of delayed justice dispensation in the country. The acting CJN said the Court of Appeal and the Supreme Court would  remain congested so long as the number of appeals proceeding there from the high courts was not regulated. Justice Onnoghen also argued that it was erroneous to believe that delay at the Supreme Court was as a result of not having up to 21 Justices prescribed by the constitution. US President Donald Trump's one-time campaign chairman secretly worked for a Russian billionaire to assist President Vladimir Putin, the Associated Press (AP) news agency reports.
